While, the State Governments of Andhra Pradesh, Chhattisgarh, Gujarat, Himachal Pradesh, Jharkhand, Maharashtra, Odisha and Rajasthan, have reported no complaint of transfer of land from tribal people to private parties without their consent, the Government of India has made appropriate provisions in the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (FRA) to ensure right of tribal people related to their land or natural resources. As per the provision of the Act, no member of forest dwelling Scheduled Tribes and other Traditional Forest Dwellers shall be evicted or removed from forest land under his occupation till the recognition and verification procedure under this Act is complete. The provisions of Panchayats (Extension to Scheduled Areas) Act, 1996(PESA) also provide protection for acquisition of land in the Scheduled Areas, besides the respective State laws for land alienation.
